Counsel for the petitioner undertakes to file affidavit-of-service before this Court by tomorrow. Despite service, the respondents are not represented.
It is submitted that in aid of the proceeding under Section of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short SARFEASI Act, 2002), the Bank has applied before the District Magistrate, Purba Burdwan for assistance under Section 14 of the SARFAESI Act, 2002 on 24th May, 2018. The said application is pending since 2018. Counsel for the Bank is unable to explain what steps the Bank has taken after filing of the application from 2018 till filing of the instant writ application. Be that as it may, the District Magistrate, Purba Burdwan shall dispose of the application under Section 14 of the said Act of 2002 filed by the Bank of Baroda, Asset Recovery & Management Branch, Kolkata being Case No. 67 of 2018 within a period of
four months from the date of communication of a copy of this order.
In view of the above, the instant writ application shall stand disposed of.
There will be no order as to costs.
All parties are directed to act on a server copy of this order on usual undertakings.
