Report submitted by the learned advocate appearing for the State be kept with the record. The petitioners complain that in spite of repeatedly informing the police station, no steps have been taken. Last of such representation was on 19th October, 2023 addressed to the Officer-inCharge, Pragati Maidan Police Station along with copies to the superior officers. Additionally, it has been submitted that because of the act and action of the private respondents, petitioners are suffering. State has submitted a report of the Officer-inCharge, Pragati Maidan Police Station dated 6th February, 2024.

I have considered the contentions advanced by the petitioners and I am of the view that since substantial time has passed and police authorities did not take any steps, petitioners would be at liberty to approach the jurisdictional Magistrate under Section 175(3) of the BNSS. Learned Magistrate would assess, ascertain whether a cognizable offence is made out and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 1980 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
