BIBEK CHAUDHURI, J. : - 1.

This is an application for expeditious disposal of G.R. case No. 3327 of 2012 arising out of Naihati Police Station Case No. 174 of 2012 dated 15th May, 2012 under Sections 498A/ 406/ 34 of the Indian Penal Code presently pending before the learned Judicial Magistrate, 4th Court at Barrackpore.

On perusal of the averment made in the instant revision and having heard the learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the State. Accordingly, Mr.

Manoranjan Mahata learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mr. Manoranjan Mahata learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned advocate for the petitioner that the case was initiated on the basis of a written complaint made by one Sarmistha Majumdar Bhattacharjee being the wife of petitioner herein before the Naihati Police Station on 15th May, 2012 alleging, inter alia, that after their marriage in the year 2010 she was subjected to physical and mental torture by the petitioner and her in-laws which propelled her to leave her matrimonial house. The petitioner was arrested and was granted bail by the learned Court below on 21st May, 2012. After completion of investigation charge was framed on 19th February, 2018 under sections 498A/ 406/ 34 of the IPC with a total of 6 witnesses fixing next date for evidence on 18th January, 2019 after almost one year. On several occasions prosecution failed to produce any witness and the next date has been fixed on 12th May, 2023 for evidence. 4.

Under such circumstances, petitioners have prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the trial court to conclude the trial within July, 2023 and dispose of the above mentioned case as expeditiously as possible within August 2023.
