The revisional application earlier appeared on 27th June, 2023 and was fixed today.
Today, when the matter has been called, none appears on behalf of the petitioners.
Ms. Ratna Ghosh, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appearance may be regularised by the concerned authorities. The subject matter of the revisional application relates to quashing of the charge-sheet arising out of New Township Police Station Case No.15 of 2022 dated 16.02.2022.
I have scrutinized the enclosure to the revisional application which includes only the report under Section 173 of the Code of Criminal Procedure. None of the documents under Section 207 of the Code of Criminal Procedure which are relied upon to arrive at the conclusion by the investigating agency have been enclosed.
Having regard to the same, I am of the opinion that the revisional application was preferred at a premature stage.
Petitioners would be at liberty to canvass their points before the learned trial court at the appropriate stage of the proceedings. No interference is called for.
Accordingly, CRR 306 of 2023 is dismissed.
Pending application, if any, is consequently dismissed All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
