Mr. Mrityunjoy Chatterjee Mrs. Suchismita Chakraborty Mr. Prem Raj Sharma ....for the petitioner Mr. Madhusudan Sur, ld. APP Mr. Santanu Deb Roy ....for the State Learned counsel appearing on behalf of the petitioner submits that other than the statements of a co-accused, there is no other incriminating material available against the petitioner. Charge sheet has already been filed.

Learned counsel appearing on behalf of the State files a report, which is taken on record. He opposes the prayer for anticipatory bail and submits that other than the Statements of co-accused, there are CDR and SDR records showing frequent phone conversations between the present petitioner and the other principal co-accused at the relevant time.

Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
