The petitioner intends to organise a peaceful protest rally on 30th January, 2026 from 11 am to 3.30 pm from Sitala Mandir to 200 meters away from Narendrapur police station comprising 3000 persons. Permission sought by the petitioner in this regard has been turned down by the police authority on 28th January, 2026.

Learned counsel for the State submits that since the proposed route of the rally is a congested route, the rally may block free flow of traffic and impede smooth passage for the passersby. Learned counsel suggests that the rally may commence from Sitala Mandir, take a left turn and continue through E.M. Bypass and thereafter below the bridge till 200 meters away from Narendrapur police station.

The petitioner agrees to such proposal.

In view of the above, the petitioner is permitted to organise a rally from 11 am to 3.30 pm on 30th January, 2026 subject to the following conditions.

1. The number of participants in the rally shall not exceed 2000 at any given point of time;

2. Sound system used shall be within the permissible limits as prescribed by the Hon'ble High Court, Calcutta and West Bengal Pollution Control Board;

3. The rally shall commence from Sitala Mandir, take a left turn and pass through E.M. Bypass and below the bridge before reaching the location 200 meters away from Narendrapur Police Station. In the event the petitioner seeks to commence the rally from the E.M. Bypass itself, such intimation shall be furnished before the police authority by 7 pm tonight.

4. Speeches capable of inciting violence, provocative speeches and abusive language will not be permitted;

5. The petitioner shall furnish the names of 20 volunteers along with their mobile phone numbers before the police authority by 7 pm tonight. The volunteers shall be responsible in the event of any violation or untoward incident;

The participants shall not obstruct traffic/vehicular movement and shall not cause any road blockade. It is directed that the participants will cling towards the left side of the road so that the traffic movement at any point of time is not affected/stalled.

7. The participants in the procession shall act in a manner to ensure that there is no damage to public property, assault on any Government servant or any other transgression of law;

The participants shall abide by the instruction of the on duty police officers and shall act in a manner to ensure that no inconvenience whatsoever shall be caused to the public at large;

9. Sufficient police personnel shall be deployed throughout the route in order to avoid any untoward incident and to ensure maintenance of peace and tranquility.

10. The petitioner shall hold a demonstration, as prayed for, at the culminating point 200 meters away from Narendrapur Police Station in terms of the conditions laid down above.

11. Delegation of 5 members shall be allowed to enter the police station for submitting deputation.

12. The participants at the rally shall disperse within 4.30 pm;

The writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the website copy of this order duly downloaded from the official website of this Court.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
