(Via Video Conference) Initially the matter was listed on 01.07.2009 but none had appeared on behalf of the petitioner and accordingly, this Court has directed to list the matter in the monthly list of September, 2009. The matter was again listed 23.11.2009 but none had appeared on behalf of the petitioner but in the interest of justice the case was adjourned till today. When the matter was called today none had appeared on behalf of the petitioner.

It appears from record that since after the filing of the case the petitioner is not interested to proceed with the matter.

Hence, the writ petition being WPA 866 of 2009 is dismissed for default.
