Mr. Arup Kumar Bhowmick ....for the petitioner Mr. Saibal Bapuli, ld. APP Mr. Arani Bhattacharyya ....for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that similarly circumstanced co-accused was denied the benefit of anticipatory bail by this Court. Apart from other things, there are call records of phone calls being made between the present petitioner and the said co-accused, whose anticipatory bail was rejected.

Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
