Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Ms. Baisali Basu, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

The petitioner has preferred the present revisional application for quashing of the proceedings arising out of English Bazar Police Station Case No. 991 of 2022 dated 23.06.2022. The enclosures to the revisional application are only the ordersheets and the charge-sheet under Section 173 of the Code of Criminal Procedure.

Learned advocate appearing for the petitioner submits that there is a complete difference of the Trade Mark and in spite of the same, the police authorities have falsely implicated the petitioner and his company in connection with the allegations made by Jindal Steel authorities. I have considered the prayer of the petitioner, but however as the documents which the prosecution has collected and relied upon to prepare the charge-sheet have not been presented before this Court, I am of the opinion that the present revisional application is premature. The petitioner

would be at liberty to take out an appropriate application under Section 227/239 of the Code of Criminal Procedure at the appropriate stage of the case before the learned trial court.

The learned trial court would independently consider such application without being influenced by any observations made by this Court while disposing of the present revisional application.

With the aforesaid observations, the revisional application being CRR 286 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
