The revisional application has been filed challenging the order dated December 11, 2020 passed by the learned District Judge at Alipore in a proceeding for divorce on mutual consent. The learned Judge did not consider the application filed by the petitioner praying for virtual hearing as the petitioner was living in USA and could not attend the hearing on the next date.

The wife appears before this Court and submits that in view of the travel restrictions followed during the pandemic situation, justice would be sub-served if the evidence of the husband and interaction with the husband could be held by the learned Court on the next date fixed over video conference.

I do not find any reason not to allow such prayer of the petitioner which is also supported by the wife and

I direct the learned Court below to take expeditious steps so that the modalities for recording the evidence of the husband and further interaction with the husband could be done virtually on the next date fixed. The parties are given liberty to file an application along with the server copy of this order before the learned Court below with the necessary prayers for implementation of this order. This Court has not made any observation on the merits of the case and the learned Court below will proceed in accordance with law and independently.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
