We think it fit to dispose of the appeal after dispensing with all formalities.

On hearing learned counsel for the parties, we dispose of the appeal (S.M.A.T. 2 of 2023) and the connected application (CAN 1 of 2023) by modifying the impugned judgment and order dated 15th December, 2022 to the effect that execution proceedings would remain stayed till the disposal of the Miscellaneous Case No. 53 of 2021. The said miscellaneous case has to be decided within two months from communication of this order.
