01.03.2024 Sl No.10 Court No.8 (gc) CPAN 168 of 2024 In MAT 1300 of 2022 Ananya Biswas (Ghosh) Vs.

Sanjoy Chattopadhyay, The District Inspector of Schools (S.E.), Kolkata Mr. Kazi Sajjad Alam, Ms. Afsana Khatun, Mr. Mainul Thander ...for the Petitioner.

Mr. Supriyo Chattopadhyay, Mr. Sabyasachi Mondal ...for the Alleged Contemnor.

1. In view of the mistake in our order dated 13th October, 2023 in referring to the date of notification as 13th November, 2013 instead of 13th November, 2019, the District Inspector of Schools (S.E.), Kolkata could not consider the representation.

Unfortunately, this was not brought to our attention by the State authorities at the time when we passed this order or even at the subsequent stage. On such wrong premise, we directed the presence of the District Inspector of Schools (S.E.), Kolkata. If these facts were not known to us, we would not have directed him to be present.

2. Under such circumstances, we modify our order dated 13th October, 2023 by directing the D.I. who is present in Court today to reconsider the matter on the basis of the notification dated 13th November, 2019 and pass a fresh order within four weeks from this date.

3. All other directions in the order dated 13th October, 2023, however, shall remain unaltered.

4. Accordingly, the contempt application stands disposed of.

5. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
