Tapan Karmakar v. State Of West Bengal And ORS.
16.03.2021 rc/ct.no.10 Item No.11 WPA No. 2465 of 2021 Mr. Soumyajit Bhatta ...for the Petitioner Mr. S.S.Koley ...for the WBSEDCL This is a fourth round of litigation between the parties.
The grievance of the petitioner is directed against a reasoned order passed by the Grievance Redressal Officer dated January 21, 2020 pursuant to an earlier direction of this Court.
Advocate appearing on behalf of the Respondent Corporation submits that the petitioner has an alternative efficacious remedy in law and should approach the Ombudsman.
After having heard the parties I am of the view that the petitioner should avail the statutory alternative efficacious remedy and file an application before the Ombudsman for assailing the order dated January 21, 2020.
If such application is made by the petitioner within a period of two weeks from date before the Ombudsman, the Ombudsman is requested to consider and dispose of the same after giving an opportunity of hearing to the petitioner and all other affected parties and by passing a reasoned order within a period of four weeks from the date of filing of such application.
It is made clear that nothing in this writ petition in so far as the merits of the case are concerned would be binding upon the Ombudsman in considering the application of the petitioner.
Since no affidavit is called for, the allegations contained in the writ petition are denied.
With the aforesaid directions this petition being WPA No. 2465 of 2021 stands disposed of.
There shall, however, be no order as to costs. (Ravi Krishan Kapur,J)
