Supplementary affidavit filed by the petitioner is taken on record.

The petitioner was serving as District Child Protection Officer, Nadia. Complaint was made against him alleging violation of the Juvenile Justice Act and financial malpractice. The petitioner was directed not to attend office until further orders.

It appears that a show cause notice was also issued to him permitting him to show-cause why action will not be taken against him for breach of responsibility and for violation of the Juvenile Justice Act, 2015.

3. The petitioner claims to have submitted his response to the show cause notice. Allegation is that the final order has not been passed till date. The petitioner is aggrieved as the post of District Child Protection Officer has been filled up.

4. The engagement letter of the petitioner as the District Child Protection Officer has not been annexed to the writ petition. The terms and conditions of his engagement have not been placed before the Court.

5. As it appears that a show cause notice was issued to the petitioner which has been replied by him, accordingly, the concerned authority ought to take steps to consider the response of the petitioner and reach the show cause notice to a logical conclusion in accordance with law.

The instant writ petition, accordingly, stands disposed of directing the concerned authority to consider the response given by the petitioner to the show cause notice and intimate the fate of the same to the petitioner.

A decision shall be taken in the matter at the earliest but positively within a period of three months from the date of communication of this order. 6.

The writ petition stands disposed of.

All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
