The records of the case reflect that one of the accused persons preferred an application for bail being Special Leave to Appeal (Crl.) No.(s) 9163 of 2025, wherein, the Hon'ble Supreme Court by an order dated 09.10.2025 was pleased to direct for completing the trial within a period of three months.
However, the submissions advanced on behalf of the State as well as the petitioner reflect that towards the end of the trial, it was found that the expert's report which was already in the record was not taken into consideration as it was not known to the prosecution.
Be that as it may, it has also been submitted that in addition to the charges which have been framed, the prosecution has prayed by way of Section 311 of the Cr.P.C. and the examination of another 28 witnesses which has been allowed by the trial court.
Additionally it is submitted that, in all, 28 witnesses will be examined freshly and 11 witnesses will be examined on recall.
Having regard to the previous order passed by the Hon'ble Supreme Court on 09.10.2025, I am of the view that the ends of justice should not be suffered at this stage for the time which has been consumed.
Accordingly, I direct the learned trial court to conclude the 39 witnesses proposed to be examined by the prosecution within two months preferably by 27th May, 2026.
In case, the prosecution is unable to complete the witnesses by 27th May, 2026, the learned trial court will release the petitioners on bail on such terms and conditions
as it deems fit and proper for ensuring further appearance in course of the trial.
With the aforesaid observations, CRM(M) 311 of 2026 is disposed of.
The learned advocate for the petitioner and the State would communicate this order to the learned jurisdictional court.
