This application has been filed for expeditious disposal of Title Appeal No. 35 of 1999 along with Misc. Case NO. 1 of 2012, pending before the learned Additional District Judge at Baruipur, South 24 Parganas.

Having considered the records, this court finds that the Misc. Case has been pending since long. The prayer of the petitioners are innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. Hence, disposal of this revisional application does not require service of prior notice. The learned court below shall dispose of the Misc. Case within a month from the next date fixed. Thereafter, Title Appeal shall be disposed of within the following six months.

This court has not expressed any opinion either on the merits of the Misc. Case or on the pending Title Appeal.

A copy of the revisional application along with a server copy of this order be served upon the opposite parities and/or their learned advocates contesting the matter in the learned lower appellate court, within a week.

The revisional application is accordingly disposed of.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
