1. Today, Mr.

Banerjee, learned advocate representing the HMC on instructions would submit that although a copy of the plan has been made over by the petitioner to the municipality, such plan is not complete in its entirety. Only, a truncated copy has been submitted.

2. Having regard to the submissions made in Court today, I am of the view that the petitioner may approach the municipality with copies of the plans to support the construction from the 2nd to the 4th floor at holding No. 64/3, Kashinath Chatterjee Lane, under Ward No. 33, Howrah.

3. For the said purpose, the municipal authorities are directed to decide upon the petitioner's representation dated 1st November, 2025 in accordance with law as expeditiously as

WPA 2201 of 2026 possible preferably within a period of 6 weeks from the date of communication of this order.

4. It is made clear that if the petitioner does not disclose additional documents, it will be open to the municipality to dispose of the representation by passing a reasoned order and for taking steps as may be advised. The order shall be communicated to the petitioner.

5. The order of demolition passed by the municipality dated 17th October, 2025 shall, however, abide by the result of the determination to be made by the municipality.

6. With the above observations and directions, the writ petition is disposed of.
