This is an application praying for quashing of a proceeding being ACGR Case No.4685 of 2023 arising out of Anandapur Police Station Case No.253 of 2023 dated 10.09.2023 under Sections 498A, 406, 323, 506 and 34 of the Penal Code.
Report filed on behalf of the State is taken on record which contains the statement of the de facto complainant and a copy of the terms of settlement arrived at between the private parties in respect of a matrimonial proceeding.
Heard the learned counsels for the private parties. According to them, a settlement and compromise has been arrived at between their clients of all disputes that had led to the registration of the Anandapur Police Station Case No.253 of 2023 dated 10.09.2023. According to the terms, a sum of Rs.12,50,000/- (Rupees Twelve Lakhs, Fifty Thousand only) has already been paid as alimony. The rest amount of Rs.10,00,000/- (Rupees Ten Lakhs only) is supposed to be paid at the time of dissolution of marriage for which a date has been fixed by the learned Civil Court. Learned Counsel appearing on behalf of the State submits that the State would not come in the way if the private parties arrived at a settlement. It also does not appear from the case diary that there is any injury report present. It appears that a settlement and compromise has been arrived at between the private parties of all disputes that had led to the initiation of the instant criminal proceeding.
In view of the above and in the interest of justice, the impugned proceeding is quashed on the ground of settlement.
The revisional application and the connected application are disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
