The petitioner was an approved Assistant Teacher of a Secondary School, his grievance is that after superannuation on May 31, 2022 till date he has not received his pension and other retiral benefits.

Mr. Grourav Das, learned advocate for the State respondents files photo copy of the instruction he has received from the District Inspector of Schools (S.E.), Purba Medinipur, the respondent no.3 herein, let it be kept with the record.

The said report discloses that the service of the petitioner was approved on January 24, 2014. In terms of G.O. No. 136-Edn(B) dated May 15, 1985, to get the benefit of pension the concerned teacher is required to complete at least a tenure of ten years of service which the petitioner is lacking,

the length of his service is eight years six months eleven days.

The petitioner therefore is not entitled to pension, the report however discloses that on March 6, 2023 the gratuity file of the petitioner has been submitted to the DPPG, West Bengal.

Mr. Das submits that within two weeks the gratuity of the petitioner would be disbursed. The concerned authority is directed to disburse the said gratuity amount with interest @ 8% per annum.

The W.P.A. 2084 of 2023 is disposed of with the above direction without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
