And In Re : Abutorab Sk. @ Abu Torab Hossain Petitioner Mr. Prosenjit Mukherjee For the petitioner Mr. Bidyut Kumar Roy Ms. Kumkum Mitra For the State Mr. Aniket Mitra For the WBSEDCL Apprehending arrest in connection with Murarai Police Station Case No. 292 of 2016 dated 27.10.2016 under Sections 135(1)(a) and 135(1)(b) of the Electricity Act, 2003 and SPL(E) No. 307 of 2016, the present application has been preferred. The learned advocate for the petitioner submits that the final assessment bill is of Rs.49,044/-, so assessed by the electricity authorities. He undertakes to deposit the aforesaid sum within a period of fortnight from date.

Mr. Aniket Mitra, learned advocate for the W.B.S.E.D.C.L. submits that in this case there were four assessment orders, which were shown in a single F.I.R.

In view of the rival submissions of the parties, we direct that if the present petitioner, after deposit of the aforesaid amount, appears before the learned Special Court, taking up electricity matters within the District of Birbhum, the learned Special Court

would assess the genuinity and authenticity of the document and thereafter, if the learned Court is satisfied, would release the petitioner, namely, Abutorab Sk. @ Abu Torab Hossain, on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each and on condition that the petitioner would appear before the learned Trial Court on each and every date, so specified, and any violation of the same would entitle the learned Trial Court to cancel his bail without any further reference to this Court. With the aforesaid observations, the application, being CRM 934 of 2021, is disposed of.
