Ms. Monisha Sharma .....For the State This present revisional application has been preferred at the instance of the accused namely, Jyotirmoy Bairagi. The petitioner is aggrieved by the fact that although the case was initiated in the year 2020, there has been no progress in the trial of the case, although, charge-sheet has been submitted.

Petitioner is directed to serve a copy of the revisional application upon Ms. Monisha Sharma, learned advocate who ordinarily appears for the State and is directed to represent the case on behalf of the State. Her appointment may be regularized by the concerned authorities. Having regard to the fact that, the charge-sheet has already been submitted and the copies are yet to be supplied upon the present petitioner and other accused person, I direct the learned Judicial Magistrate, 5th Court, Barrackpore to take steps so that the copies are supplied on the next date fixed for hearing of this case.

Learned Trial Court after effecting service of copy would fix at least one date in a month for the purpose of the present case being, Belghoria

Police Station Case No.608 of 2020 dated 14.11.2020 (corresponding to G.R. Case No.720 of 2020) so that the charge can be framed within three months of the next date so fixed and the trial of the case be taken to its logical conclusion within 12 months thereafter. All efforts must be taken to conclude the trial and no unnecessary adjournment should be granted to any of the parties.

With the aforesaid observations, C.R.R.294 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
