It has been uniformly submitted by the learned advocates for the petitioner and the opposite party that the suit has been dismissed in the meantime. Mr.

Chowdhury, learned senior advocate, assisted by Mr. Gupta, learned advocate appearing for the petitioner submit that they are contemplating to file an appeal against the judgment and decree passed by the learned trial judge.

In view thereof, the civil revisional applications stand disposed of. It will be open to the petitioner to take all points which may be available to the petitioner in the appeal.
