Golam Nure Imrohi ...... for the petitioner Mr. Saibal Bapuli, Mr. Arani Bhattacharya ...... for the State Apprehending arrest in connection with Berhampore Police Station Case No.369 of 2020 dated 19.04.2020 under Sections 341/325/326/307/506/332/333/353/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act and Sections 3/4 of Explosive Substance Act, the present application has been filed. Records reveal that earlier the petitioner preferred an application for anticipatory bail being CRM No.7962 of 2020 and the same was dismissed by an order dated 20th October, 2020. Heard the learned advocates and considered the materials in the case diary.

Since there had been no substantial change in the facts and circumstances subsequent to the date of dismissal of the petitioner's earlier application for anticipatory bail, we are not inclined to exercise any discretion in favour of the petitioner and his prayer for anticipatory bail is rejected.

The application for anticipatory bail being CRM 946 of 2021 is dismissed.
