It appears that a co-ordinate Bench of this court on 31.1.2011 had directed the petitioner to serve a copy of the application under section 24 of Code of Civil Procedure along with copy of the supplementary affidavit upon the opposite party by registered post with A.D and file affidavit of service on the next date of hearing. An interim order of stay of the proceeding in the matrimonial suit was granted. But thereafter none has appeared on behalf of the petitioner. Even after obtaining stay of the proceeding in the suit petitioner has not even bothered to comply with direction of the court. Therefore, the application under section 24 of the Code of Civil Procedure is dismissed. Interim order of stay granted earlier stands vacated. (Shivakant Prasad, J.)
