It is unfortunate that the learned Advocate appearing for the petitioner has not come up with clean hands and he is very unfair in suppressing the fact that on earlier occasion on 15th of February, 2022, this matter was adjourned on the joint submission of the parties that on the issues involved in this writ petition, appeal is pending before the Division Bench and in the meantime, the mater has been decided by the Appeal Court by holding in favour of the Revenue and this fact was not brought to my notice by the learned Advocate appearing for the petitioner and Mr. Siddiqui, learned Advocate appearing for the State respondents has brought this fact to my notice. On the ground of suppression of this fact and this unfair conduct of the petitioner, this writ petition, being WPA 1969 of 2022 is dismissed.
