The revisional application is fixed up today for hearing. None appears for the petitioner.

Mr. Binoy Panda along with Mr. Pratick Bose, learned advocates appear for the State. The appointments of the State advocates may be regularized by the concerned authority.

Perused the revisional application wherein the petitioner prayed for quashing of the proceedings arising out of Belda Police Station Case No. 79 of 2013 dated 3.4.2013 under Sections 448/376(D)/506 of the IPC, pending before the learned Chief Judicial Magistrate, Paschim Medinipur. It appears that no stay order was passed on any earlier occasion. Several years have passed after filing of this application, but the petitioner has not turned up with his affidavit of service upon the opposite party.

Heard learned advocates for the State who submits that the revisional application may be disposed of.

Considered the submissions and the materials in the case record including the impugned proceedings and orders passed by learned Sessions Judge, Medinipur. The allegation relates gang rape and the entire proceedings cannot be diluted on the basis of an extra judicial affidavit.

The revisional application is, therefore, dismissed for default. The same is accordingly disposed of.
