The petitioner was granted immunity of arrest in an application for anticipatory bail. The Co-ordinate Bench was of the view that the rigor of Section 37 of the N. D. P. S. Act is not attracted but the tenure of the anticipatory bail is restricted to eight weeks within which the petitioner was directed to appear before the jurisdictional Special Court to pray for regular bail. In this application, it is stated that due to pandemic and disruption in transport service, petitioner could not comply with the aforesaid direction as he was at Bengalore for his avocation. It is further stated that he is a daily labourer and earns livelihood at Bangalore and the reason as stated above creates a fetter in praying for bail within the time stipulated in the said order.

After hearing the respective counsel and bearing in mind the disrupted logistic services throughout the country, we

extend the time to appear before the jurisdictional Special Court and pray for regular bail by two weeks from date. The application being CRAN 1 of 2021 is hereby disposed of.

For the purpose of record, it is made clear that C.R.M.948 of 2021 was already disposed of on 21.4.2021 and, therefore, shall not be shown as pending in the docket of this Court.
