C.R.R. 2 of 2015 With CRAN 1 of 2015 (Via Video Conference) In the matter of: Prabir Kumar Kar ......Petitioner.

This revisional application has been filed by the petitioner under Sections 397/401 read with Section 482 of the Cr.P.C praying for setting aside the order dated 5.7.2014 passed by learned Judicial Magistrate, 5th Court, Barrackpore in C. Case No. 42 of 2014 under Sections 495/417/419/420/504/506 and 34 of the IPC.

A separate application being CRAN 1 of 2015 has been filed stating that there has been delay of 79 days in filing of the application for revision and the delay may be condoned on the ground that the petitioner obtained the certified copy of the order on 18.12.2014 due to illness of his law clerk.

Considered the materials in the application of CRAN as well as the impugned order and the revisional application. I do not find any satisfactory reason to condone the delay. As such the application being CRAN 1 of 2015 is dismissed.

C.R.R. No. 2 of 2015 also stands dismissed.

Let a copy of this order be sent to learned Judicial Magistrate, 5th Court, Barrackpore for information.
