The petitioner assails a communication dated December 21, 2020 rejecting the application of the petitioner dated December 17, 2021. The Advocate appearing on behalf of the CESC Limited submits that the petitioner resides at a different place and is seeking new electricity connection at a different place.

In view of the submissions made on behalf of the CESC Limited, I am of the view that the Writ Court is not the appropriate remedy for the petitioner. The disputed questions of fact which arise for consideration in this petition cannot be adjudicated in these proceedings. The petitioner is granted liberty to apply afresh for new electricity connection in accordance with law. If such application is made, the CESC Limited is directed to consider and dispose of the application of the petitioner in accordance with law.

Accordingly, WPA No. 2522 of 2021 stands disposed of.

There will be however, no order as to costs.
