Mr. Lall, Advocate appearing on behalf of the CESC Limited relies on an order dated February 05, 2021 passed in CAN No. 1 of 2021 in MAT No. 73 of 2021 (CESC Limited Vs. Asifa Bibi). He also submits the petitioner has alternative remedy. He submits that under Regulation 53 Clause 14 of the West Bengal Electric Regulatory Commissioner (Recovery of Expenditure for Providing New Connections) Regulation Act, 2013 the petitioner is to file a proper application before the Ombudsman to redress his grievance.
In view of the statutory remedy available to the petitioner, the petitioner is granted liberty to file an appropriate application in respect of the new electricity connection before the Ombudsman within a period of two weeks from date. If such application is made, the Ombudsman is directed to consider and dispose of the same within a period of four weeks from the date of receipt of such application after giving opportunity of hearing to the petitioner.
With the aforesaid directions and observations this writ petition being WPA No. 2530 of 2021 stands disposed of without any order as to costs.
