Learned advocate appearing for the petitioner, i.e. complainant submits that although the complaint case was initiated in the year 2014, but the prosecution till date could not complete the evidence because of continuous adjournments sought for by the accused persons.
In view of the anxiety expressed by the learned advocate appearing for the petitioner/complainant regarding the time consumed in concluding the trial under the provisions of Negotiable Instruments Act, I direct that the learned Judicial Magistrate, 10th Court, Alipore would on and from 16th February, 2023 fix one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. Any party to the case praying for time should be penalised with cost for adjournment. All efforts must be taken so that the trial of the case is completed at the earliest.
With the aforesaid observations, CRR 304 of 2023 is disposed of.
