Mr. A.K. Biswas, learned advocate for the petitioner submits that the petitioner is not in touch with him since long. In spite of his best efforts, he has not been able to get in touch with the petitioner. Considering the conduct of the petitioner and in the interest of justice, he prays that the matter may be dismissed for non-prosecution as it is a case of 2019. But the petitioner may be granted liberty to sue afresh.

Miss Rita Dutta, learned advocate for the State present in Court who represents the State is appointed in this case.

Learned Public Prosecutor to regularize the said appointment of Miss Dutta.

Accordingly, the Criminal Revision being 160 of 2019 is hereby dismissed for non-prosecution with liberty to sue afresh.

Interim order, if any, stands vacated.

Department is directed to send a copy of this order to the trial court for information and necessary action. ( Shampa Dutt (Paul), J. )
