Biswajit Mondal (Via Video Conference) Mr. Apurba Kumar Dutta ... for the petitioner Affidavit of service filed be kept on record which shows that the compliance as per the direction of this Court passed on 12.02.2021 has been made. Now the application under Section 24 of the Civil Procedure Code is taken up for hearing and consideration. Heard learned advocate for the petitioner. In this application the petitioner/wife has prayed for transfer of matrimonial suit No.1 of 2020 pending before the learned District Judge, Bankura to the learned Additional District Judge, Cossipore, Purulia, inter alia, on the grounds that the matrimonial suit has been filed with a pre-meditated mind set to harass the petitioner by making her run from pillar to post on the pretext of contesting matrimonial suit as the learned trial court is situated far away from the ptitioner's place of residence in another District and out side the

jurisdiction of the learned trial court within which jurisdiction the petitioner is residing.

It is submitted that the parent's house of the petitioner where she is residing is in the Cossipore in the District of Purulia which is near to Adra, Raghunathpur and it will be troublesome journey for her to attend Court in Bankura. That apart, the petitioner is suffering from various ailments which is evident from Annexure "P". Accordingly, having no other contention available from the rival side, let the matrimonial suit No.1 of 2020 be withdrawn from the file of the learned District Judge, Bankura and be transferred to the Court of Additional District Judge, Raghunathpur, Purulia within which jurisdiction the petitioner is residing.

Let a copy of this order be sent to the learned court namely District Judge, Bankura and Additional District Judge, Raghunathpur for their information and necessary action.
