Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 3 years 3 months. At present, there is no possibility of the trial concluding in near future as only 8 witnesses out of 19 witnesses till date have been examined.

Learned advocate for the State has produced the case diary.

I have taken into account the medico legal examination of the victim and her tender age. Having considered the same, I am of the view that the petitioner if convicted would have to face rigorous minimum punishment for 20 years. Having regard to the same, I am not inclined to release the petitioner on bail. At this stage, CRM (M)298 of 2026 is dismissed.
