Report dated 07.03.2024 submitted by Mr. Biswas, learned advocate appearing for the State be kept with the record.

Petitioners have prayed for expeditious disposal of Polba Police Station Case No. 91 of 2013 dated 06.10.2013 wherein the police authorities on conclusion of investigation submitted charge-sheet within a reasonable proximity of time. It has been submitted before this Court that although charge was framed, but till date none of the witnesses has been examined.

The Officer-in-Charge, Polba Police Station will submit report, if required regarding any of the accused person who has expired during the pendency of this case to the court of the learned Judicial Magistrate, 5th Court, Sadar, Hooghly on the next date so fixed. The Officer-in-Charge will additionally submit a report regarding the availability of all the witnesses cited by the prosecution in the charge-sheet. The learned Judicial Magistrate, 5th Court, Sadar, Hooghly will fix one date in every fifteen days for the purposes of the present case for examination of the witnesses concerned.

It is directed that in spite of any resolution of the local Bar, the present proceeding would continue and the learned participating advocates will not stall the proceedings on any reason whatsoever.

All efforts be taken by the learned trial court to conclude the examination of the witnesses which are eight in number by 31.12.2024. The learned trial court will thereafter examine the accused persons under Section 313 of the Code of Criminal Procedure and put in efforts so that verdict of the case is pronounced by 15.04.2025.

With the aforesaid observations, the revisional application being CRR 391 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
