Rahman ...for the petitioner Ms. Sujata Das Ms. Soubteya Ganguly ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the first wife of the principal accused in this case. Suddenly, a woman being the de facto complainant appeared and claimed to be the second wife of the said principal accused and tried to create a ruckus.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She submits that the petitioner happens to be the second wife of the de facto complainant's husband. The petitioner's husband got married to the de facto complainant eight years ago. There is a child from such marriage. It is alleged that on the particular day, the petitioner's husband forcibly got the gate of the victim's house opened and entered the premises. He allegedly caught hold of the victim while the present petitioner and her mother poured rat poison into her mouth. Thereafter, she had to remain admitted in the hospital for three days.

Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
