Mr. Ahmed, learned Advocate appearing for the petitioners, in his usual fairness, submits that from the averments made in the affidavit-inopposition filed on behalf of the Central Pollution Control Board and the documents annexed thereto, it appears that, citing certain environmental issues, the Board has declined to grant a licence in favour of the petitioners to enable them to operate the sugar mill.

He further submits that since such environmental issues have been raised, the petitioners intend to approach the National Green

Tribunal, which is the appropriate forum for raising such issues.

In view thereof, he seeks to withdraw this writ petition with liberty to approach the learned Tribunal.

The respondents did not oppose such innocuous prayer made on behalf of the petitioners. In view thereof, the prayer is allowed.

Accordingly, the writ petition is dismissed as withdrawn, with liberty granted to the petitioners to approach the learned Tribunal on the selfsame cause of action by filing an appropriate application in accordance with law.

It is clarified that this Court has had no occasion to go into the merits of the issues raised in this writ petition.
