Kausik CRM (NDPS) 210 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with N. Case No. 9 of 2025 arising out of New Barrackpore Police Station Case No. 104 of 2025 dated 05.04.2025 under Sections 21(b)(ii)C/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that there was an alleged recovery of 23.4 Kgs. of Ganja from the possession of the present petitioner.

Petitioner is in custody for 311 days and although charge sheet has been submitted but till date charges have not been framed.

Learned advocate appearing for the State opposes the prayer for bail.

Having regard to the quantum of seizure in the present case and the stage at which the petitioner has approached this Court, I direct the learned Special Judge (Under NDPS Act)

Barrackpore, North 24 Parganas to release the petitioner on such terms and conditions as the learned Special Court would deem fit and proper for ensuring the appearance of the petitioner in course of further trial after the charges are framed by the said Court.

With the aforesaid directions CRM (NDPS) 210 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
