Galib, Sr. Government Advocate Mr. Tamal Taru Panda ..for the State The petitioner has challenged the order dated 23rd September, 2008 passed by the Block Land and Land Reforms Officer rejecting the prayer of the petitioner for correction of the record of rights. The petitioner is aggrieved by an order passed by an authority under the West Bengal Land Reforms Act, 1955, which is a specified act under Section 2 ( r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997.

In view of the alternative efficacious remedy available under the 1997 Act, this Court is not inclined to entertain this writ petition.

Faced with such situation the learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to approach the West Bengal Land Reforms and Tenancy Tribunal.

In the light of the submissions made by the learned advocate for the petitioner, WPA 2377 of 2026

stands dismissed as withdrawn with the liberty to approach the appropriate forum in accordance with law on the self same cause of action.

It is, however, made clear that this Court has not gone into the merits of the claim made in the writ petition and the appropriate forum will be free to decide all points in accordance with law.
