Affidavit of service filed in Court today is taken on record.

None appears on behalf of the private respondent. The notice of upgradation was also not served upon the private respondent.

As the order passed herein will not prejudice the private respondent in any manner whatsoever, accordingly, the writ petition stands disposed of as under.

The petitioner's application seeking appointment as Muslim Marriage Register was pending consideration at the end of the Law Department, State of West Bengal who forwarded the same to the Inspector General of Registration.

The petitioner is aggrieved as the authority has engaged the private respondent as temporary MMR without disposing of the petitioner's application which was made at a prior point of time.

Without entering into the allegation made in the writ petition, as it appears that the petitioner's application for appointment as MMR is currently pending consideration before the Inspector General of Registration, accordingly, the instant writ petition is disposed of by directing the Inspector General of Registration to take steps to consider the prayer of the petitioner in accordance with law at the earliest and dispose of the same positively within a period of eight weeks from the date of communication of this order. An opportunity of hearing may be given to all the necessary parties.

A reasoned order shall be passed and communicated to the petitioner immediately thereafter. 8.

Learned advocate for the petitioner is directed to forward a copy of the application made by the petitioner seeking engagement along with all other supporting documents to the respondent no. 3 at the time of communicating the order of the Court. 9.

Instruction of the OSD & Ex-Officio Joint Secretary, Law Department dated 11th February, 2025 is taken on record.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
