Apprehending arrest in connection with Burdwan P. S. Case No. 114 of 2013 dated 25.01.2013 under Sections 364/302/201/34 of the Indian Penal Code, the petitioner has filed the present application.
Mr. Datta, learned advocate for the petitioner submits that the petitioner is innocent of the charges and the police authorities have never tried to apprehend him. Mr. Sur, learned advocate for the State submits that the petitioner is named in the FIR and the case was registered in the year 2013.
Having considered the fact that the case was registered in the year 2013 and charge-sheet was subsequently filed on 30th September, 2013, we are of the opinion that the petitioner has been evading the process of law and as such, he is not entitled to the benefit of anticipatory bail.
Accordingly, the prayer for anticipatory bail, being CRM 966 of 2021, is rejected.
