Kausik CRM (NDPS) 211 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jagacha Police Station Case No. 164 of 2025 dated 21.07.2025 under Sectioins 20(b)(ii)(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that from 3 accused persons, 23 Kgs. of Ganja were allegedly recovered.

Learned advocate for the State draws the attention of the Court to the seizure list.

I have taken into account the overall circumstances and it has been also informed that date has been fixed for consideration of charges.

Having considered the quantum of seizure in the present case, I direct the learned Judge, Special Court, under

NDPS Act, Howrah to release the petitioner on bail after the stage of consideration of charges are over.

Learned Court would allow the petitioner to furnish bond on such terms and conditions as the learned Court deems fit and proper thereby ensuring his further appearance before the Court in course of trial.

With the aforesaid observations CRM (NDPS) 211 of 2026 is disposed of.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
