Dr. Sutanu Kumar Patra, counsel appearing on behalf of the West Bengal School Service Commission, submits that the Commission is in the process of verifying whether the petitioner is entitled to claim the one additional marks and if found that petitioner is so entitled, the same shall be given to them by the School Service Commission.

As such submission has been made by Dr. Patra, no further order needs to be passed in this writ petition. Needless to say, after obtaining one mark if the petitioner qualifies and comes within the range of persons who are being appointed, the West Bengal School Service Commission shall act in accordance with law.

With these above observations and directions, this writ petition stands disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
