This is an application under Article 226 of the Constitution of India wherein the petitioners are aggrieved by an order of rejection dated November 11, 2019 on the application of the petitioners for award of R.O. dealership. I have heard counsel on behalf of both the parties and perused the materials on record. Upon perusal it is clear that the reason given in the said order is not correct and, therefore, the said order is quashed and set aside. The Bharat Petroleum Corporation Limited is directed to consider the application of the petitioners in accordance with law. It is to be noted that the petitioners have already filed all the required/rectified documents before the authority concerned.

The writ petition is disposed of. There shall be no order as to costs.

Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
