The petitioner is aggrieved that the absconding accused in a trial under Sections 448/326/302/307/34 of the IPC are constantly threatening him.

The petitioner is a de facto complainant.

The Ausgram Police have obtained orders of proclamation and attachment after the warrant could not be executed.

4.

Since the trial is under way, the Ausgram Police shall post a picket comprising of two constables outside the petitioner's residence.

5.

The petitioner shall share any information about the absconding accused with the police and every attempt shall be made to apprehend the said absconding persons.

6.

With the aforesaid observations, the instant writ petition shall stand disposed of.

7.

There shall be no order as to costs.

8.

The Superintendent of Police, Purba Bardhaman shall ensure compliance of the aforesaid order. 9.

The report of the Ausgram Police Station dated 20.02.2023 is kept with the record.

10.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
