05.02.2024 sdas rejected C.R.M.(DB) No. 336 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Singur Police Station Case No. 230 of 2023 dated 16.06.2023 under Sections 420/406/409 of the Indian Penal Code.

Learned Counsel for the petitioner submits he is in custody for 222 days. It is also submitted he is the manager of the co-operative society and did not play any role in the crime. Investigation is complete. He prays for bail. 2.

Learned Counsel for the State opposes the prayer for bail and submits petitioner and co-accused i.e. cashier in conspiracy have misappropriated Rs.228.89 lakh from various depositors in the co-operative society.

We have considered the materials on record.

Petitioner is the manager of the co-operative society concerned. He in collusion with the cashier had misappropriated deposits made by various members of the said co-operative society. Misappropriated sum runs over Rs.2 crore. Keeping in mind

gravity of the offence we are not inclined to grant bail to the petitioner at this stage.
