The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Canning Women Police Station Case No. 18 of 2020 dated 14-02-2020 under Sections 376(2)(n)/370/372/373/323/328/120B of the Indian Penal

Code and read with sections 3/4/5/6/7/9 of the Immoral Traffic (Prevention) Act.

The plea of defective jurisdiction has been taken out in the instant case. The petitioner has been arrested in connection with the aforementioned case alleging a serious offence having committed.

We have perused the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure which, prima facie, establishes a nexus of the petitioner with the alleged offence.

We, therefore, do not think that this is a fit case where the petitioner should be enlarged on bail and as such, the prayer for bail of the petitioner is rejected. With the aforesaid observations, the application for bail being CRM 972 of 2021 is, accordingly, disposed of. (Harish Tandon, J.) (Tirthankar Ghosh, J.)
