In course of hearing, learned advocate for the writ petitioner at the very outset draws attention of this Court to Page Nos. 26 and 27 of the instant writ petition being a copy of the letter dated 20.09.2023 addressed to the General Manager, South Eastern Railway requesting him to disburse compensation on acquisition of the land of the writ petitioner.

It is the grievance of the writ petitioner that despite submission of such representation, the respondents/authorities sat tight over the matter and practically did nothing.

Per contra, learned advocate appearing on behalf of the respondent/Union of India and its functionaries submits before this Court that the instant writ petition is devoid of any merit inasmuch as at the time of acquisition, no land of the writ petitioner was acquired.

Considering the rival submissions of the learned advocates for the contending parties and on careful perusal of the entire materials as placed before this Court, this Court while disposing the instant writ petition directs the respondent no. 1/authority to consider the representation

of the writ petitioner dated 20.09.2023 in accordance with law and after giving an opportunity of hearing to the writ petitioner and/or his authorized representative shall pass a reasoned order and shall forthwith communicate such reasoned order to the writ petitioner preferably by mail, if the mail details of the writ petitioner is provided to him at the time of hearing.

The entire exercise as indicated in the foregoing paragraph is to be completed within 60 working days from the date of communication of the server copy of this order. 6.

The time limit as fixed by this Court is mandatory and preemptory.

Liberty is given to the learned advocate on record of the writ petitioner to communicate the server copy of this order to the respondent no. 1.

8.

The respondent no. 1 is directed to act on the server copy of this order.

9.

With the aforementioned observations, the instant writ petition being WPA 2125 of 2024 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
