Learned advocate appearing for the petitioners submits that the petitioners are in custody for 153 days and the investigation has been concluded as charge-sheet has been submitted.

Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that the petitioners intended to enter India from Bangladesh and were intercepted. Petitioners submit that there are sufficient documents to establish their citizenship.

If an application is filed before the learned Magistrate, learned Magistrate will find necessary directions for enquiry for ascertaining the genuinity of such allegations. At this stage, I do not find that this is a fit case for releasing the petitioner on bail.

Accordingly, CRM (M)300 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
