Affidavit of service filed in court be taken on record. The grievance of the petitioner is directed against a final assessment bill raised by the respondent distribution company.

It is submitted on behalf of the petitioner that the petitioner be permitted to pay a sum of 50 % of the disputed bill.

Counsel appearing on behalf of the respondent distribution company submits that this is a case of theft of electricity and the petitioner has an alternative and efficacious remedy available to him under Section 127 of the Electricity Act, 2003.

Heard the parties.

Having considered the submissions made on behalf of the parties, I am of the view that in view of the alternative efficacious remedy

available to the petitioner under Section 127 of the Electricity Act, 2003, there is no scope of entertaining this petition.

The petitioner is directed to file an appeal before the appropriate authority under Section 127 of the Electricity Act, 2003.

With the aforesaid directions WPA 2584 of 2021 is dismissed However, there will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
